Unifund CCR is one of the larger debt buying companies out there and they file a lot of lawsuits against consumers in Arizona. Debt buyers like Unifund claim that they have purchased old charged off debts and then file debt collection lawsuits to try and recover money from you.
Often when people are sued by companies like Unifund the first reaction is to panic. In this article I hope to give you a glimpse into why your case against Unifund is more winnable than you may think.
The Debt Has Often Changed Hands Several Times Before Landing with Unifund CCR
In the world of debt buying things are constantly changing. Many times by the time a lawsuit has been filed the account has been bought and sold by numerous companies. In the typical Unifund CCR case I often see that the debt has been sold at least four (4) times prior, usually by companies with names like Pilot Receivables Management, Unipac IX, Unifund CCR Partners, and countless others.
The more often the debt has changed hands the better your case is. The reason being when a debt buyer like Unifund takes a case to trial they are required to prove not only that you had an account with the original creditor, but also prove that they are actually the current owners of the debt. If they can’t prove this, they can’t win.
You may think this would be easy for Unifund to prove but often it isn’t. Debt buyers pay very little for the accounts they purchase (usually about 4 cents on the dollar). When you pay little you generally get little in return. And Unifund doesn’t get much for its 4 cents. They get very little documentation and I have yet to see them get access to witnesses from the prior owners that would be able to come into court and testify as to the debt.
Documents and witnesses are needed in trials. Without them all Unifund has is their own statements alleging that they own the debt and what is actually owed – generally not enough to support a judgment.
So while it is no fun at all to get sued by a debt buyer, know this, your case is better than you think and you may just be able to get them to go away for good. You can do this!
